2. PURPOSE OF PROCESSING
The data will be processed for the management of the reservation, the provision of the service and commercial prospecting of our services/products, as well as to avoid duplication with other restaurants that share reservation software.
The personal data provided will be kept for the time that is strictly necessary, as long as the deletion of the same is not requested, or until they no longer meet the purpose for which they were collected.
3. LEGITIMATION
The legal basis on which the data processing is based is as follows:
Unequivocal and express consent of our customers to receive the service provided.
Execution of a contract or pre-contractual measures.
Legitimate interest
Follow-up of legal obligations.
4. TARGET
Data may be transferred to suppliers or for statistical purposes.
The data is transferred to RESTAURANT BOOKING SOLUTIONS SL (CoverManager) for the management of reservations under a data processor contract. More info about CoverManager’s privacy policy at https://www.covermanager.com/politica-privacidad/. Data may also be transferred to other restaurants that share the same reservation software only for the purpose of detecting duplicates.
5. RIGHTS
You are entitled to the following rights under the RGPD:
- Right to request access to personal data, you may request information from the person responsible for a file on whether your personal data is being processed.
- Right to request rectification allows you to request the modification of data that are inaccurate or incomplete.
- The right to object to the processing, allows you to request that the data cease to be processed under the legally established requirements.
- Right to request its deletion: to revoke the consent given and request the deletion of personal data.
- Right to limitation of processing: the right to demand that measures be applied to such data in order, among other things, to prevent their modification or, where appropriate, their erasure or deletion.
- Right to data portability: o request that the information be provided in a structured and clear format to another Data Controller.

6. SHIPPING POLICIES
After placing an order for a digital product through our site, you will receive an on-screen message and an email from us with details of your order and confirmation that we have received your order.
The contract for the purchase of any digital product will be between you and us and is only formed when we make the digital product available for download and have received payment in full for the digital product. Until we make the digital product available for download and receive payment in full there is no contract between you and us for the digital products. We reserve the right, at our sole discretion, to reject any order we receive.
7. AVAILABILITY AND DELIVERY
All digital products listed on our site are subject to availability. We reserve the right to modify or remove a digital product or other content from the site at any time without notice or liability to you. For example we may have rights obtained from third parties to make the digital product available and, in the event we lose these rights, it may be necessary to remove the digital product from the site and cease to make it available for purchase.
We will make every effort to make it clear that the digital products offered are available for a limited time or in limited numbers.
We update our site regularly to avoid errors, but it takes time to update our site and we cannot guarantee that a particular digital product will be available at any particular time.
Some digital products may be available for pre-order or reservation which means that they will not be available for download until the scheduled release date. Digital products will normally be available for download on the day of release. It is possible that occasionally from time to time, they may not be available (e.g. technical difficulties / unavailability of our site) and we do not guarantee that any digital product ordered prior to the release date will be available on the previously published release date. Release dates may be subject to change
8. CANCELLATIONS AND REFUNDS
You can notify us of the cancellation of your order by sending an email to reservas@restaurantecoque.com with the subject: “Gift Card Purchase Cancellation” indicating your order number and telephone number so that we can contact you. Once you have notified us of the cancellation of your order, the amount charged by us from your credit or debit card will be credited back to your account as soon as possible and in any event within 30 days of your cancellation.
9. ENTIRE AGREEMENT
We intend that the provisions of these terms and conditions of sale and any documents expressly referred to in them shall constitute any contract relating to the digital products. If you are unsure about your rights or think there is an error or that the terms are not complete and accurate or do not reflect any conversation with our customer service representatives, please contact us before placing an order in order to discuss your query and concern as we only accept responsibility for statements made in writing. In this way, we can avoid problems around what we and you expect in relation to the contract for the digital product.
